Fly tipping

Fly tipping - report it

Fly-tipping is the illegal dumping of waste. It can vary in scale from a bin bag of rubbish to large quantities of waste dumped from trucks. Roadsides, lay-bys and private land are just some of the areas material is fly-tipped.

Common types of fly-tipped waste are

  • Household waste
  • Large domestic items such as fridges and mattresses
  • Garden waste
  • Commercial waste such as builders rubble, tyres and clinical waste

Fly-tipping can be a threat to humans and wildlife. It also damages our environment and spoils our enjoyment of the Derbyshire Dales. Those who collect and fly-tip waste are also undermining the reputation of legal operators.

We work in partnership with the Environment Agency and together deal with fly tipping. We both have the power to tackle and clean up fly-tipping on public land, including roads and lay-bys. The clearing up of fly-tipping on private land is the responsibility of the landowner.

Fly-tipping is a serious criminal offence that carries a fine of up to £50,000 (unlimited if the case goes to the Crown Court). You could also face a prison sentence of up to five years. You could face the same penalties if you allow someone to fly-tip on your land or if a vehicle registered in your name is involved in fly-tipping.

Check the licence

If you are disposing of waste you could face penalties up to £5,000 if you don't check that the company or person you give waste to has a licence to carry waste or does not take it to a licensed disposal site. You can check whether a company is licensed to carry waste by searching the Environment Agency public register.

Reporting a fly-tip

If you witness a fly-tip or encounter fly-tipped waste please report it online. We will visit the site and where possible, collect evidence.  If there is enough evidence to prosecute the offender, we will.
