Smoke control areas

Under the Clean Air Act 1993 the District Council can declare all, or part, of its area as a Smoke Control Area.

This power is used to improve areas that suffer from widespread smoke pollution and is not intended to be used to tackle individual smokey chimneys or bonfires. Nuisance powers under the Environmental Protection Act 1990 are available to deal with individual complaints or issues surrounding point sources of smoke.

There are no smoke control areas in the Derbyshire Dales. Further information on Smoke Control Areas, exempt appliances and authorised fuels can be found on the Defra UK Smoke Control Areas website.
