Fly-tipping is the unauthorised dumping of waste on public or private land by persons who do not have the occupier or owner’s permission to do so, and land for which a relevant waste management licence does not exist.
Fly-tipping is a major cause of public dissatisfaction and, if remains un-cleared for extended periods of time, seriously detracts from the amenity value of the area and could lead to injury to people and wildlife, in particular where the waste is of an hazardous nature.
Fly tipping is illegal and irresponsible. It is an offence under Section 33(a) of the Environmental Protection Act 1990 to deposit waste on any land other than that which is controlled by a waste management licence.
The Environmental Health section of the district council works in partnership with the Environment Agency to investigate instances of fly tipping with a view to the prosecution of offenders.
If you see someone illegally disposing of their waste, please report this to the district council giving as much information as possible. Any information provided will be treated in the strictest confidence and will assist the district council to take the enforcement action against fly-tippers.
If the land is privately owned, the district council will try to identify and contact the occupier or land owner to ensure they arrange for the removal of the waste.
Derbyshire Dales District Council will remove fly-tipped waste if it is on the public highway or district council-owned land. This will generally be undertaken within one working day from notification.
