Your Business, Your Waste, Your Legal Duty:
Every business must comply with the Environmental Protection Act 1990, Waste Management: Duty of Care. This 'duty of care' is a law which says that you must take all reasonable steps to keep waste safe. If you give waste to someone else, you must be sure they are authorised to take it and can transport, recycle or dispose of it safely. If you break this law, you can be fined an unlimited amount.
Derbyshire Dales District Council offer a commercial/trade waste collection service to businesses in the area which fully meets the Duty of Care requirements. There are two methods of commercial or trade refuse collection.
Commercial / Trade Waste Collection Arrangements:
Green Trade Sacks: These can be purchased in rolls of 25 from Matlock, Ashbourne or Bakewell Council offices. These are ideal for businesses which produce 1 – 2 bags of refuse per week. Cost per 25 sack roll is £48.00 +VAT.
Wheeled bins for commercial waste: Bins are emptied a minimum of weekly but increased frequencies can be negotiated as required. The District Council do not provide a skip service for Commerical Waste.

All new trade waste collection agreements will be payable by Direct Debit. Invoices can be paid on line by following this link: Paying Council invoices on line.
Current Legislation
The Duty of Care law falls withing section 34 of the Environmental Protection Act 1990. New legislation within the Clean Neighbourhoods and Environment Act 2005 gives Waste Collection Authorities and the Environment Agency the power to issue Fixed Penalty Notices to anyone who fails to produce a copy of their waste transfer note when requested to do so by the relevant authority or agency. This penalty is set at £300. Once paid, the offender is no longer liable for failing to supply the said documentation. Should the fine be left outstanding, the District Council will commence legal proceedings that may result in a penalty of up to £5000 on summary conviction or an unlimited fine on conviction on indictment.

Derbyshire Dales District Council offers a service of Category A clinical commercial waste collection. To organise a collection of such items please contact us using the addresses, numbers or form below. Charges are as follows:
Charges for commercial premises £89.00 per sack, per annum (1 sack per week)
Charges for industrial premises £230 per sack, per annum (1 sack per week)
Commercial Waste: Special Trade Collections / Loose Box Collections:
Any business can request a one off collection of trade waste bulky items. To request such a service please contact us using the addresses, numbers or form below. Charge is £61 +VAT per hour which includes traveling time and disposal costs.
Commercial Waste Spillage:
All commercial and trade waste is collected on behalf of Derbyshire Dales District Council by Cleanaway Ltd. Cleanaway limited are the registered waste carrier and waste disposal company and as such would deal with any spillage issues arising from their vehicles. On site spillages or incorrect waste storage is the responsibility of the business in question.
Commercial Waste: Hazardous Waste Collection:
Hazardous waste must be segregated from other waste, collected by specialist registered collectors and taken to an approved disposal site for hazardous waste.
