Local Development Scheme
The Government has indicated that it would like all local planning authorities to move to new arrangements as quickly and as smoothly as possible. Consequently the work that the Council has undertaken on the review of the Derbyshire Dales Local Plan over the past four years will not be lost. The Town and Country Planning (Transitional Arrangements) Regulations 2004, allow the Council to move forward with the adoption of the Derbyshire Dales Local Plan Revised Deposit Draft under the old regulations and for the policies to be 'saved' for a period of three years once the plan is adopted.
The Act does, however, require the Council to prepare a Local Development Scheme (LDS). This provides the starting point for the local community to find out what the Council's current planning policies are for the area and sets out the programme for the review and preparation of Local Development Documents (LDDs) that will form the Council's Local Development Framework (LDF) over the next three years. The LDS will be reviewed annually and rolled forward as necessary.
The documents proposed in the LDS include the Statement of Community Involvement (SCI), Development Plan Documents (DPDs) and Supplementary Planning Documents (SPDs). Under the Act, DPDs, together with the Regional Spatial Strategy (RSS), comprise the Development Plan.
A revised LDS was submitted to the Secretary of State on 28th March 2007, and on 26th April 2007 the Government Office for the East Midlands advised the Council that the Secretary of State did not intend to issue a direction under Section 15(4) of the Planning and Compulsory Purchase Act 2004. The Secretary of State did, however, indicate that before the LDS is brought into effect that the document should be amended to allow an extra month, six months in comparison to 5 months, between the examination and the receipt of the Inspector’s report in respect of the Housing and Employment Allocations DPD. These amendments have been made and in accordance with Regulation 11 of the Town and Country Planning (Local Development) (England) Regulations 2004 the Council's Partnership & Regeneration Committee on 14th June 2007 resolved that the LDS shall have effect from 15th June 2007.
